Andy Max Tools software is intended EXCLUSIVELY for professional use by:

• Professional auto electricians

• Vehicle diagnostic and repair technicians

• Automotive industry operators with adequate technical skills

Use of the software by individuals lacking the necessary technical skills is strongly discouraged and may cause serious damage. The Licensor assumes no liability in case of improper use.

5.2 Risks of use

Working on vehicle electronic control units involves intrinsic risks, including:

• Possible permanent damage to the control unit ("brick")

• Malfunction of the ABS or other related systems

• Compromise of vehicle safety

• Loss of original data and configurations

• Need to replace electronic components

• Significant repair costs

The user acknowledges and accepts these risks and declares to possess the technical skills necessary to manage them.

5.3 User responsibilities

The user is solely responsible for:

• Verifying compatibility of the software with the specific vehicle and control unit

• Backing up the original control unit configurations before any intervention

• Using hardware (OBD interfaces, power supplies, cables) of adequate quality and in good working order

• Ensuring proper operating conditions (stable power supply, charged battery, controlled environment)

• Operating in compliance with all applicable regulations

• Obtaining the necessary authorizations from the vehicle owner

• Keeping documentation of operations performed

5.4 Licensor's exclusion of liability

The Licensor is NOT liable, to any extent, for:

• Damage to the electronic control unit subject to the intervention

• Damage to related vehicle systems (engine, transmission, safety systems, etc.)

• Costs of repair, replacement or recoding of components

• Vehicles that, after the intervention, do not work or present malfunctions

• Loss of vehicle or manufacturer warranty

• Consequences of interventions performed on vehicles not owned by the customer or without the owner's authorization

• Operations performed on stolen, recycled or illegally sourced vehicles

• Legal, civil or criminal consequences arising from the use of the software

• Personal injuries caused by the use of the software or by the vehicle after the intervention

• User errors, lack of skills, incorrect configurations

• Power outages, hardware issues, OBD interface malfunctions

• Incompatibility with specific models, production years, control unit variants

5.5 Regulatory compliance

The user is solely responsible for ensuring that use of the software complies with the laws and regulations applicable in their country of operation, including by way of example:

• Road traffic regulations

• Vehicle emissions and safety regulations

• Regulations on tampering with anti-theft devices

• Consumer protection regulations

• Privacy and data protection regulations

It is expressly forbidden to use the software for unlawful purposes, including:

• Tampering with control units on stolen vehicles

• Recycling vehicles of unlawful origin

• Manipulating data for fraud (e.g. odometer modification)

• Bypassing anti-theft systems on vehicles not owned by the user

• Any other activity in violation of law

The Licensor reserves the right to cooperate with the competent authorities in case of suspected unlawful use of the software, providing usage logs, account data and any other information requested.

5.6 Verification of legitimacy of operations

The user undertakes to:

• Verify the identity and ownership rights of the customer before any intervention

• Document operations performed (date, vehicle, VIN, reason, authorization)

• Keep such documentation for the time required by applicable regulations

• Refuse interventions on vehicles of doubtful or suspicious origin

5.7 Technical support

Technical support provided by the Licensor is limited to:

• Clarifications on use of the software

• Resolution of software malfunctions

• Assistance on license and credit issues

Technical support does NOT cover:

• Vehicle or control unit diagnostics

• Operational guidance on how to perform specific interventions

• Resolution of vehicle problems following the intervention

• Technical training on the automotive industry

5.8 Technical updates

The Licensor undertakes to release software updates to extend compatibility with new models, fix errors and improve functionality. However, it does not guarantee specific release timelines nor the inclusion of specific features or vehicles requested by users.

5.9 Acceptance of the disclaimer

By proceeding with the purchase and use of the software, the user expressly declares to:

• Have fully read and understood this Technical Disclaimer

• Possess the technical skills necessary to use the software

• Fully accept the risks related to interventions on electronic control units

• Release the Licensor from any liability for direct or indirect damages

• Operate in full compliance with applicable regulations
